PASSENGER TERMS OF CARRIAGE
Terms of Carriage and Essential Onboard Safety Conditions
These Terms of Carriage and Essential Onboard Safety Conditions form part of the contract of carriage and apply to every booking, ticket, voucher and voyage provided by the legal carrier or operator identified in the booking confirmation or ticket. The Terms are made available to the passenger before completion of the booking and remain available on the website. By completing the booking and, in any event, by boarding, the passenger confirms having had the opportunity to read and accept them, always subject to the passenger’s mandatory rights.
1. Ticket, identification and timely boarding
The ticket or booking is personal and valid only for the notified journey. Each guest must provide any identification lawfully required for the passenger manifest and must be ready to board at least 15 minutes before the notified departure time. A guest who misses departure is not automatically entitled to a refund or alternative transport, subject to applicable law and the booking conditions.
2. Compliance with authorities and applicable rules
Guests must comply with all applicable Port Authority, immigration, customs, public-health and other competent-authority requirements, and must provide any document lawfully required for the voyage.
3. Health, mobility, pregnancy, medication, injury and recent surgery
Before boarding and again before any activity, every guest must inform the Master or crew if the guest feels unwell, is pregnant, has limited mobility, is taking medication relevant to safe participation, is recovering from an injury or recent surgery, is subject to medical advice or restriction, or has any other circumstance that could affect safe travel or participation. Only practical information needed for safe assistance is requested; a detailed diagnosis is not required. Where appropriate, the guest should obtain medical advice before travelling or participating.
4. Swimming ability and fear of water
A guest who cannot swim, is not a confident swimmer, is afraid of the sea, feels anxious in or near the water, or requires a lifejacket or other assistance must inform the Master or crew before boarding and before every water-related or off-vessel activity.
5. Mandatory restriction on activities
A guest to whom any circumstance described in Conditions 3 or 4 applies MUST NOT enter the water or participate in swimming, snorkelling, watersports, tender transfers or any other off-vessel activity unless the Master or an authorised crew member has first been informed and expressly permits participation with any required safety measures. The Master or crew may prohibit, restrict or stop participation whenever they reasonably consider it unsafe.
6. Master’s authority and onboard order
Guests must comply promptly with every lawful safety and operational instruction given by the Master and crew and must behave in a manner that does not endanger themselves, another person, the vessel or property. The Master’s reasonable safety decision is final on board.
7. Vessel movement, stairs, steps and openings
A vessel may move suddenly because of sea, wind, wake, manoeuvring or anchoring. Guests must walk carefully, use handrails, maintain secure contact when moving, observe stairs, steps, hatches, low headroom and changes in deck level, and must not step backwards near stairways or openings.
8. Items provided for passenger use
The vessel moves, and any item placed on a table or other surface, such as a glass, bottle, plate, champagne bucket or ice bucket, may move or fall. If you believe that an item in front of or near you may cause injury, move away from it and immediately ask the crew to remove it. The Company, Shipowner, Master and crew shall not be liable for any injury or damage caused by an item moving or falling if the passenger did not request its timely removal.
9. Wet decks and suitable footwear
Decks, stairs and other surfaces may become wet or slippery because of sea or weather conditions, spray, cleaning or guests returning from swimming. The crew may not be able to dry every surface immediately. Guests must walk, not run, use handrails, wear suitable footwear and report any spill, damaged fitting or unsafe condition immediately.
10. Running, jumping, dancing and unsafe movement
Running, jumping, unsafe dancing, climbing on furniture or rails, sudden uncontrolled movement and any other careless conduct are prohibited where they may cause injury or damage.
11. Embarkation, disembarkation, restricted areas and transfers
Guests must follow the crew’s instructions during embarkation, disembarkation and any transfer by tender or other craft, request assistance when needed, remain in permitted areas, use safe seating and keep passages, stairs and emergency access routes clear.
12. Emergency equipment and procedures
Guests must attend and understand the safety briefing, note the location and use of lifejackets, emergency exits, firefighting equipment and the muster or assembly point, and immediately follow all emergency instructions.
13. Swimming, snorkelling, tenders and off-vessel activities
Participation is allowed only when expressly authorised by the crew and within the designated area, time and conditions. Guests must comply with instructions, use supplied safety equipment and request assistance where needed. Permission may be withdrawn at any time because of weather, sea state, health, ability, conduct or another safety concern.
14. Alcohol, drugs and unsafe conduct
A guest must not consume alcohol or use any substance to an extent that impairs judgement, movement or safe behaviour. Threatening, abusive, reckless or unsafe conduct is prohibited. Alcohol service or participation in an activity may be refused, restricted or stopped and, where lawful and reasonably necessary, the guest may be required to disembark safely.
15. Minor passengers
A person under 18 must be accompanied by a parent or legal guardian and remain under that adult’s normal supervision throughout embarkation, disembarkation, time on board, swimming stops and all activities. The crew cannot provide continuous individual childcare. A minor must not remain on board if the responsible adult disembarks unless another lawful arrangement has been expressly accepted by the operator.
16. Illness, accident and medical transfer
Where reasonably necessary, the Master may provide or arrange first aid, call emergency services, divert the vessel, return to port or arrange transfer ashore by the vessel or another available craft. External medical providers and facilities are independent; nothing in this condition excludes liability that cannot lawfully be excluded.
17. Immediate reporting of incidents and complaints
Any injury, illness, unsafe condition, loss, damage or complaint must be reported immediately to the Master or crew so that assistance, evidence and any required notification can be arranged. If not resolved on board, the matter should be submitted promptly to the legal carrier or operator.
18. Personal belongings and valuables
Do not bring on board any item of significant financial, personal or sentimental value if its loss, theft, damage or destruction would cause you serious distress or lead you to seek compensation. Such items include, without limitation, cash, negotiable instruments, jewellery, watches, precious metals or stones, works of art, family heirlooms, collectors’ items, items of sentimental value, expensive clothing and accessories, mobile phones, tablets, laptops, photographic cameras, video cameras, lenses, drones and any other expensive, valuable or fragile equipment.
Each passenger is solely responsible for the safekeeping, supervision and secure handling of their personal belongings during embarkation, the voyage, any activities and disembarkation. The Carrier, Operator, Shipowner, Master and crew do not accept personal belongings for safekeeping. Any assistance provided by a crew member with the carrying, moving or temporary placement of an item shall not constitute acceptance of that item for safekeeping or a separate assumption of liability.
The Carrier, Operator, Shipowner, Master and crew shall not be liable for the loss, theft, disappearance, damage, breakage or destruction of any personal item unless it is proven that the incident was caused by their own act or omission. If liability is established, and to the extent permitted by applicable law, the total and cumulative compensation for all personal belongings of the individual affected passenger shall not exceed the individual fare paid for that passenger and that particular voyage. The individual fare means exclusively the amount attributable to the individual affected passenger and not the total price of any group booking, private excursion or charter of the vessel.
Any loss or damage must be reported immediately to the Master and, in all cases, before the passenger disembarks from the vessel.
19. Prohibited and dangerous items
Explosives, flammable or hazardous substances, illegal drugs, weapons, knives intended as weapons and other prohibited articles must not be brought on board. The operator may refuse carriage, secure an item, notify the authorities or request a lawful inspection of baggage where reasonably necessary for safety or required by law.
20. Animals and assistance dogs
Animals and pets are not permitted unless expressly accepted in advance by the operator. Recognised assistance dogs will be handled in accordance with applicable law, safety requirements and prior operational arrangements.
21. Guest-caused damage, fines and expenses
To the extent permitted by law, a guest may be required to compensate the operator for proven damage, fines, penalties or reasonable expenses directly caused by that guest’s unlawful, intentional or reckless conduct or serious breach of a safety instruction.
22. Weather, authorities, safety events and force majeure
The Master or operator may delay, deviate, omit a stop, alter an anchorage, change or stop an activity, return to port or cancel a voyage because of unsafe weather or sea conditions, orders of the Port Authority or another competent authority, technical or operational safety concerns, rescue or medical needs, or force majeure, subject to applicable law and mandatory passenger rights.
23. Vessel substitution and alternative arrangements
Where reasonably necessary, the operator may substitute another suitable vessel, modify the schedule or offer carriage on another date or vessel. Any resulting refund, rebooking, assistance or other right will be determined by applicable law and the booking conditions.
24. Cancellation, schedule and refunds
Unless the booking confirmation states more favourable terms, a cancellation by the guest received at least 24 hours before scheduled departure is eligible for a refund of 100% of the fare paid. A cancellation received less than 24 hours before departure and a no-show are non-refundable, except where mandatory law provides otherwise. If the operator cancels or materially changes the cruise, the guest’s remedy will be determined by applicable law and the booking conditions; nothing in these Terms limits a mandatory passenger or consumer right.
25. Prices, taxes and charges
The confirmed fare will not be changed except as expressly agreed or where a mandatory tax, fee or charge is lawfully imposed and may be passed to the guest. Any such amount will be communicated transparently.
26. Time ashore and independently selected services
Guests must observe every notified reboarding time. Activities ashore or services independently selected by the guest and not organised or controlled by the operator are outside the operator’s control; responsibility remains governed by applicable law and the relevant service arrangements.
27. Data protection
The legal carrier or operator identified in the ticket or booking confirmation is the controller of personal data provided in connection with the booking, ticket or voyage. Data are used for passenger and vessel safety, operational assistance, emergency response, legal compliance and, where necessary, the establishment, exercise or defence of legal or insurance claims. Access is limited on a need-to-know basis and information may be disclosed where necessary to vessel personnel, medical providers, public authorities, the operator’s appointed insurance broker or intermediary, insurers, the P&I Club, claims handlers, surveyors and legal advisers. The appointed broker or intermediary may process relevant data, including as an independent controller where applicable, to arrange or administer insurance, advise the operator or Assured, notify insurers or the P&I Club and assist with claims, in accordance with applicable law and its privacy notice. Data are retained only as required by the applicable documented retention policies and legal or claims periods. Requests concerning the operator’s processing and other data-protection rights may be sent to info@spiridakos.gr. Any health information voluntarily disclosed for safety or emergency assistance will be processed only for those purposes, on the basis permitted by applicable law.
28. Responsibility and preservation of mandatory rights
To the extent permitted by law, a guest may be responsible for proven loss, damage, expense or injury caused by that guest’s intentional or reckless conduct, unlawful act or serious failure to follow a safety instruction. Nothing in these Terms excludes or limits any mandatory legal right of a passenger, relieves any person of liability contrary to applicable law, lowers a mandatory liability limit, shifts a burden of proof contrary to law or prevents the passenger from pursuing a lawful claim.
29. Governing law and jurisdiction
These Terms, every booking, ticket or voucher and the related contract of carriage shall be governed by and construed in accordance with Greek law. Subject to any mandatory rule and any choice of jurisdiction available to the passenger under an applicable international convention, European Union law or Greek law, the Courts of Piraeus, Greece, shall have jurisdiction over any dispute. To the extent that an exclusive jurisdiction agreement may validly be made, the Courts of Piraeus, Greece, shall have exclusive jurisdiction.
